This Privacy Policy explains how BrandTelligence Sdn. Bhd. [Reg. No. 202501038531 (1639940-D)] in Malaysia and BrandTelligence (Pty) Ltd [Reg. No. 202452075307] in South Africa (together "BrandTelligence", "we", "us", or "our") collect, use, disclose, and safeguard your personal information when you use our website, the Solutions Hub, and our products and services. We are committed to processing personal information lawfully and transparently, in line with the Protection of Personal Information Act, 2013 (POPIA) in South Africa and the Personal Data Protection Act 2010 (PDPA) in Malaysia.
1. Who we are
Depending on the region your relationship with us originates in, your data controller / responsible party is the relevant BrandTelligence entity above. 2. Personal information we collect
- Identity & contact data — name, email address, phone number, company, and role.
- Account data — Solutions Hub credentials and access logs.
- Project data — information you share with us to deliver an engagement.
- Technical data — IP address, device and browser type, and usage data collected through cookies and similar technologies.
- Communications — messages you send us via forms, email, or phone.
3. How we collect it
We collect personal information directly from you (for example, when you complete a contact form, request a Hub account, or engage our services), automatically through cookies and analytics, and occasionally from third parties such as referral partners — always in accordance with applicable law.
4. Why we process it
We process personal information to: respond to enquiries; provide and administer the Solutions Hub and our services; deliver and improve products; manage billing and contracts; send service and (where permitted) marketing communications; maintain security; and comply with legal obligations.
5. Lawful basis & consent
We rely on one or more lawful bases for processing, including your consent, the performance of a contract, our legitimate interests, and compliance with legal obligations. Where we rely on consent, you may withdraw it at any time (see Section 12). Withdrawing consent does not affect processing carried out before withdrawal.

7. Disclosure & sharing

All processors are bound to process personal information only on our instructions and to apply appropriate safeguards.

Because we operate in both Malaysia and South Africa and use cloud infrastructure, your personal information may be transferred across borders. Where we transfer personal information outside its country of origin, we take reasonable steps to ensure it receives a level of protection consistent with POPIA (Section 72) and the PDPA, including contractual safeguards with recipients.

We retain personal information only for as long as necessary to fulfil the purposes for which it was collected, including legal, accounting, or reporting requirements. When no longer required, it is securely deleted or de-identified.
10. Security safeguards
We apply appropriate technical and organisational measures — including access controls, encryption in transit, and audit trails — to protect personal information against loss, unauthorised access, and misuse. No method of transmission or storage is completely secure, but we work to continually strengthen our safeguards.

12. South Africa — POPIA
For data subjects in South Africa, BrandTelligence (Pty) Ltd acts as the responsible party under the Protection of Personal Information Act, 2013. We process personal information in accordance with POPIA's eight conditions for lawful processing: accountability; processing limitation; purpose specification; further processing limitation; information quality; openness; security safeguards; and data subject participation.
Under POPIA you may, among other things, request access to your personal information, request correction or deletion, object to processing, and submit a complaint. Requests may be made using the prescribed forms under the Promotion of Access to Information Act (PAIA) where applicable.
13. Malaysia — PDPA
For data subjects in Malaysia, BrandTelligence Sdn. Bhd. processes personal data in accordance with the Personal Data Protection Act 2010 and its seven principles: the General Principle (consent), Notice and Choice, Disclosure, Security, Retention, Data Integrity, and Access.
In line with the Notice and Choice Principle, we inform you of the personal data we collect, the purposes of processing, and your right of access and correction. We obtain consent where required and do not disclose your personal data for purposes other than those notified to you without your consent, except as permitted by law.
14. Children's privacy
Our Services are intended for businesses and professionals and are not directed at children. We do not knowingly collect personal information from children. If you believe a child has provided us personal information, please contact us so we can remove it.

We may update this Privacy Policy from time to time. The "Last updated" date above reflects the latest revision. Where changes are material, we will provide notice through the Services or by email where appropriate.
